Dispute Resolution for Healthcare Contracting

With a team of senior healthcare finance practitioners who are now qualified through the Centre for Effective Dispute Resolution (CEDR) we have developed an independent service that will give disputing parties the opportunity to resolve contractual issues quickly and cost-effectively.

This service is designed for disputes relating to any area of healthcare contracting in the UK, including;

·         Commissioning Contracts for Acute and Primary Care Services (NHS and private  sector)

·         Education and Training Contracts

·         Shared Service Contracts

·         All Service Level Agreements

·         Managed Service Agreements

·         Outsourcing contracts

·         Partnering and Joint venture arrangements

·         Cross-border disputes

With a more pluralistic provider market and also the relative independence afforded to Foundation Trusts (in England), contractual and commercial relationships are growing more varied and complex day by day. Inevitably the likelihood of disputes arising between health organisations is likely to grow.

We believe that it's in no-one's interest for disputes to be resolved by legal redress or even arbitration where the decisions are taken by a third party.  This service includes making an initial confidential assessment of a dispute, providing a detailed case plan and running and overseeing the conduct of the Mediation from start to finish.  The service is not arbitration nor does it offer any judgements about the strength or merits of either party's case.

If your organisation is in or heading towards a dispute (with a partner or another NHS organisation) and you want to find out more, or have a confidential discussion about an existing dispute please contact one of our team.
